Electoral Process :
A. Nominations
1.Qualifications for contesting as a GHMC Ward Member:
• The person must be listed as a voter in any Ward of GHMC
• The person must be at least 21 years old
• You must belong to the appropriate reservation category, if contesting from a reserved Ward; any person can contest from a general Ward
• Should not have (any of the) disqualifications (Ref: Section 21 of GHMC Act, 1955) 2.
Disqualifications for contesting as a Ward Member:
• The person should currently not be undertaking any lease or contract for any work with the GHMC
• The person should not be employed as a paid lawyer/advocate on behalf of GHMC or functioning as a lawyer/advocate against the GHMC
• S/he not hold a judicial office in GHMC city limits
• S/he should not owe any dues to the GHMC, for which a notice has been served and the time given has expired.
• The person should not hold an office of profit with GHMC, State level or Union level.
• S/he should not be a Sarpanch, Panchayat Ward Member, MPP Member, ZPP Member, Municipal Ward Member.
• The person should not have been dismissed from public service by Union/State/Local government for misconduct and a competent authority has declared unfit for future public service
• S/he should not have been disqualified from voting in the GHMC elections (Section 20 of GHMC Act) - due to (a) conviction under Section 171E or 171F of IPC, (b) conviction for corrupt or illegal electoral practices or (c) defaulting on filing election expenses or filing false election expenses
• S/he should not have been disqualified for corrupt electoral practices (Section 20-A of GHMC Act)
• S/he should not be convicted for fraud
• S/he should not have been disqualified for not filing election expenses (Section 20-B of GHMC Act)
• The person should not have been sent to jail by a court for offences of moral turpitude.
• You should not be disqualified for contesting as an MLA/MLC.
• You should not have more than two children (after June…, 1995) (Ref: Section 20 - 23 of GHMC Act, 1955)
3. Nomination Form
• It must be filled in Form 8, Schedule A (free copies are available with the RO)
• You can submit a maximum of 4 sets of nominations
• The candidate must provide all necessary details including her/his voter list particulars (showing that s/he is a registered voter in a GHMC Ward)
• The candidate must sign the declaration at the bottom of the Form 8.
• The form needs the signature and voter particulars of one proposer, who must be a registered voter in the same Ward from which the candidate is contesting. The candidate cannot become his/her own proposer.
• A voter can propose for more than one candidate – but the one submitted first will be considered by the RO. Also, it is better to have different proposers for each set of nomination.
• The nomination must presented by the candidate or his proposer.
To be submitted along with nomination forms:
- Nomination Deposit of Rs. 2000 ( Rs. 1000 in case of SC/ST candidates)
- Certified extracts of the voter list particulars of the candidate and voter particulars of the proposer.
- Form – I (choice of symbols and name of the Political Party nominating the candidate) along with ‘B Form’ issued by the Party.
- If you are contesting from a SC/ST/BC reserved seats, Form – II must be filled by the candidate before an officer not below the rank of Deputy Tehsildar/MRO
- Form – III Declaration to abide by the Code of Conduct
- Declaration regarding the filing of accounts of election expenditure (given as Annexure – VIII in the Handbook for Candidates for GHMC Elections/Municipal Corporations; www.apsec.gov.in)
- Notarized affidavit of assets, liabilities and educational qualifications, in the prescribed format (given as Annexure – XI). Please remember that the RO cannot enquire into the contents of this affidavit.
- Declaration regarding disqualifications in the prescribed format (given as Annexure – XII in the Handbook) Q It is better to also submit the Form – XII for Appointment of Election Agent (along with a passport photo of the Election Agent) during the time of nomination itself.
After submission of your nomination, you should collect from the RO:
- Form – IV – Acknowledgment of Nomination Form
- Form V - Receipt for nomination paper and notice of scrutiny
- Receipt for deposit amount.
- Model Code of Conduct
- ECI order and details regarding maintaining and submitting election expenditure o Election Agent pass? (please confirm with the RO)
4. Scrutiny of Nomination Form
• You can take along with you, your proposer, your election agent and one other person (duly authorized in writing).
Grounds for rejection of nomination:
• The candidate is clearly disqualified for contesting as a Ward Member
• The candidate does not meet any of the qualifications
• If the proposer is not a voter in the same Ward
• If a person other than the candidate or proposer submitted the nomination papers to the RO.
• If the nomination has not been delivered to authorized office, at the authorized location, during the specified hours, in the specified dates.
• If the nomination paper in incomplete or not in the proper format.
• If deposit is not made.
• If all the supporting documents have not been submitted along with the nomination paper. You should carry the following documents for scrutiny:
• Copy of electoral roll or a certified extract proving your and your proposer’s particulars.
• Evidence about your age.
• Receipts of deposit, nomination form
• Caste certificate (if applicable)
• Any other material to defend your nomination form
B. Campaign Period
• Election campaign must be according to the Model Code of Conduct
• Permission from Municipal authorities for loud speakers; police permission for meetings, rallies, etc
• Pamphlets should have the necessary information - declaration from the printer to the ECI (Annexure A and B in the Handbook for Candidates)
• Voter slips can be printed and distributed – should not contain the party/candidate’s names, particulars, campaign slogans, etc.
• Candidate’s Election Agent must be in touch with the RO’s office for regular meetings for – EVM randomization, any changes in the polling stations, complaints, etc.
• Election expenses must be maintained in the prescribed format (given by the RO during nomination). Expenses must be filed with the District Election Authority within 45 days of the declaration of the result. (Section 617-B of GHMC Act).
C. Polling Day
• Appointment of Polling Agents as per Form 14; functions of Polling Agents and necessary documents to be carried by them as per instructions therein.
D. Counting Day
• Appointment of Counting Agent through Form 15
